These Terms & Conditions (“Terms”) govern the sale of products and use of our website and apply to purchases made via:

  • Our official eBay store
     

2. Acceptance of Terms

By accessing our website or purchasing our products, you agree to be bound by these Terms.

If you do not agree, you must not use our website or place an order.
 

3. Statutory Consumer Rights

Nothing in these Terms limits or excludes your statutory rights under UK law, including but not limited to:

  • The Consumer Rights Act 2015

  • The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013

Where these Terms conflict with statutory rights, statutory rights shall prevail.
 

4. Products

  • We sell off-the-shelf physical outdoor hiking and camping equipment.

  • Product images and descriptions are illustrative only.

  • Minor variations may occur without affecting product function.

  • We reserve the right to modify, discontinue, or restrict products at any time.
     

5. Orders & Contract Formation

  • An order constitutes an offer to purchase.

  • A legally binding contract is formed only when we dispatch your order and confirm dispatch.

  • We reserve the right to refuse or cancel orders, including due to:

    • Stock availability

    • Pricing or listing errors

    • Suspected misuse or fraud
       

6. Pricing & VAT

  • All prices are shown in GBP (£).

  • Prices include VAT, where applicable.

  • We reserve the right to change prices at any time prior to order acceptance.
     

7. Payment

We accept payment via:

  • Debit / Credit Card

  • PayPal

Payment must clear in full before dispatch. Ownership of goods does not transfer until payment has been received.
 

8. Promotional Codes

  • Promotional codes are non-transferable and have no cash value.

  • Only one promotional code may be used per order unless stated otherwise.

  • Promotional codes may be withdrawn, modified, or cancelled at any time.

  • Lost or expired codes cannot be replaced.
     

9. Delivery

  • We deliver within the United Kingdom only.

  • Orders are typically dispatched within 1 business day.

  • Delivery times are estimates and not guaranteed.

  • We are not liable for delays caused by postal services, couriers, or events beyond our control.

10. Risk & Ownership

  • Risk passes to you upon delivery.

  • Ownership of goods transfers only once payment has cleared in full.
     

11. Returns, Refunds & Exchanges

  • Returns are accepted in accordance with UK consumer law.

  • You may cancel eligible orders within the statutory cooling-off period.

  • Returned goods must be unused, in original condition, and suitable for resale.

  • Return postage costs are your responsibility, unless the item is faulty.

  • We offer refunds or exchanges once returned items are received and inspected.
     

12. Faulty Goods

Faulty or misdescribed goods will be handled in line with UK consumer legislation. Remedies may include repair, replacement, refund, or exchange as appropriate.
 

13. Outdoor Use & Product Suitability Disclaimer

  • Our products are designed for outdoor and recreational use.

  • Some products (including lightweight cordage) involve inherent risks.

  • Products are not safety-critical or life-saving equipment unless explicitly stated.

  • You are responsible for assessing product suitability for your intended use and conditions.

  • We are not liable for misuse, modification, or failure to follow reasonable safety practices.
     

14. Limitation of Liability

To the maximum extent permitted by law:

  • We exclude liability for indirect, incidental, or consequential losses.

  • Our total liability is limited to the purchase price of the product.

  • Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot legally be excluded.
     

15. Intellectual Property

All content, branding, designs, product names, images, logos, and materials are owned by ULGEAR LTD.

You must not:

  • Copy or reproduce content

  • Resell or commercially exploit materials

  • Reverse engineer products
    without prior written consent.
     

16. User Content

Where you submit reviews, images, or other content:

  • You grant us a royalty-free, worldwide, perpetual licence to use such content for marketing and promotional purposes.

  • You confirm you own or control all necessary rights.

  • We may remove content at our discretion.
     

17. Marketplace Sales (eBay)

  • These Terms apply to sales made via our website and eBay.

  • Where eBay’s platform rules conflict with these Terms, eBay’s rules take precedence.
     

18. Complaints & Alternative Dispute Resolution (ADR)

  • Complaints should be submitted to info@ULgear.co.uk.

  • We aim to respond within a reasonable timeframe.

  • We are not obliged to participate in Alternative Dispute Resolution (ADR) schemes.
     

19. Data Protection & GDPR

We process personal data in accordance with the UK GDPR and Data Protection Act 2018.

  • We collect only data necessary to fulfil orders and operate our business.

  • Data may be shared with trusted third parties (e.g. payment processors, couriers).

20. Force Majeure

We are not liable for failure or delay caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, supply chain disruption, or carrier delays.
 

21. Assignment

These Terms constitute the entire agreement between you and us and supersede all prior communications.
 

23. Waiver

Failure to enforce any provision of these Terms does not constitute a waiver of that provision.

If any provision is found unenforceable, the remaining provisions remain valid.
 

25. Governing Law & Jurisdiction

  • These Terms are governed by Scots law.

  • The courts of Scotland have exclusive jurisdiction.
